Terms of Service
These terms and conditions govern all activities at Creative Catharsis SM LLC, located at 1330 West St, Ste G, Redding, CA, 96001 further known as Creative Catharsis. By purchasing any activity at Creative Catharsis you agree to be legally bound by these Terms & Conditions, and your use shall be subject to these Terms and Conditions, as they may be amended from time to time, without further notice to you. You may obtain the latest Terms & Conditions at the premises.

By making a payment for any services provided by Creative Catharsis, you explicitly confirm that you have read our terms of service, which are fully understood and approved by you to the fullest extent.

PAYMENT
SERVICE CANCELLATION
To book available session times for your Art Experience or any other service on the premises of Creative Catharsis please phone, text or email to begin the scheduling and pay for your service at the time of booking.
PHOTO & VIDEO RECORDING
In the Art Zone, you can and we encourage you to take photos and record video, upon our approval you may us professional equipment for content creation and freely post such photo and video materials with free access over the internet, broadcast in TV programs, etc. Although there is never more than one service at a time, your participation in any event, party, or other services at the Creative Catharsis in the Art Zone automatically entails your approval to be featured in any above-mentioned programs and/or photos without compensation or additional approvals in any form from your end. With prior arrangement and approval of recorded content given to Creative Catharsis a discount of services will be provided. This entails all rights and ownership of the recorded content belongs to Creative Catharsis.
A full payment is required to book a service whether individual or group. Our services can be paid for by credit card. Cash is not accepted. Additional services on-site (extra protection against paint, order delivery of your painting, and other services), will be payable with a credit or debit card at the Creative Catharsis studio.
CLIENT OBLIGATION
Creative Catharsis and its employees are not responsible for children and adults in case of non-compliance with the safety regulations and rules established by Creative Catharsis within the premises of the art zone and general property.
In case of obscene comments made by a client, insults towards the employees or other guests, physical confrontation, and aggression, we reserve the right to refuse the provision of the services to the offender and make the offender leave the premises of the art zone. In such a case, the payment made by the offender will be retained in full regardless of the time already spent in the service or the remaining time. We reserve the right to fully prosecute any offender in accordance with the law.
In the event of service cancellation initiated by Creative Catharsis due to force-majeure circumstances, we will either provide a full refund or offer the option to reschedule your service to a mutually agreeable time and date.
In the event of a cancellation initiated by the customer, we offer the flexibility to either reschedule the service to a mutually available and convenient date and time or provide a full refund, provided that the cancellation is notified no less than 24 hours before the scheduled service time. For last-minute cancellations made less than 24 hours before the scheduled service, including instances of no-show or sickness, no refund will be provided. In the case of a service booked for three or more people, individual cancellations within the group must be communicated no less than 24 hours before the scheduled service. Any decision to decrease the group size made later than 24 hours before the scheduled service will not be eligible for a prorated refund.
3.3 If you are more than 10 minutes late for your scheduled service, Creative Catharsis will consider this a no-show and reserves the right to cancel your Art Experience and retain 100% of the payment made by you. Each service is individual and can be held only within the booked timeframe to keep the order of other scheduled services.

The art tools and materials necessary for your art experience are all included in the cost of your service.
REFUNDS
Refund processing on our end takes 7 business days.
STORAGE POLICY
Once the service is over, it takes 4 days for the painting to dry. At that time, it is possible that the texture and brightness of the painting would change and/or small cracks will appear on the painting. Our company is not responsible for the natural changes to the painting in the process of drying. You can pick it up on any day we are open for services at our studio, with advance notice alternate days and times can be arranged should it be needed at the convenience of Creative Catharsis.
You can also order delivery of your painting by postal service paying the corresponding postal service fee. You can learn more about delivery options at our studio. We are not responsible for a possible loss of the painting, damages, or other postal service mistakes, including the actions of any third person whom you have authorized to pick up your painting. You may purchase separate insurance for your painting via USPS or other courier services.
We are obliged to store your painting for no more than 14 calendar days. Once the storage period of 14 calendar days after the completion of your service is over, in case we do not receive any additional requests for the storage period extension, your silence will be interpreted as a denial of your rights over the painting. Thus, you transfer to Creative Catharsis the rights to do any actions with the painting, including repainting, disposal, giving it as a gift, or selling it.
In case the painting abandoned by you is discarded, you are not entitled to any compensation from Creative Catharsis studio whatsoever (including actual damages, consequential damages, damages for emotional distress, etc.).
SAFETY REGULATIONS
Our acrylic, water-based paint usually does not cause allergic reactions. Nevertheless, if you believe you may have any medical condition that makes it unsafe for you to participate in this activity, please consult with your doctor or refrain from participating in the service. Protect your clothes and footwear from paint. Paint is easy to wash off the skin and is difficult to wash off clothes; however, every service includes an anti-paint protection set (gown, shoe covers, gloves). Under no circumstances will Creative Catharsis be responsible for smudging and smearing on your clothing. Among the painting techniques employed at Creative Catharsis is “color blasted catharsis.” The service includes the use of pneumatic or spring-loaded airsoft gun for shooting plastic bullets at balloons filled with paint. While using such guns you are expected to comply with the following safety regulations:
- Do not point the gun at yourself and/or at other people in the art space.
- Do not look into the gunpoint.
- Do not shoot at any other targets except the ones specially designed for the service.
- Do not take the gun by yourself, without the Artist's permission.
- Make sure to use disposable plastic glasses when shooting at the balloons (provided by us).
- To create paintings, we currently use a manual pottery spinner however we will be introducing an electronic pottery spinner in the near future at which time the following safety rules apply:
o The paintings spin on the electronic wheel at a very high speed. Until the wheel has completely stopped spinning, it is strictly prohibited to:
+Try to stop the pottery spinner by yourself.
+Touch the spinning elements of the spinner until it has stopped completely.
+Turn on or turn off the pottery spinner motor on your own.
If you participate in a service with minors, you, as a parent or legal guardian of such minors, are responsible for explaining the safety regulations to them and making sure the rules are complied with. Creative Catharsis does not assume responsibility for theft or loss of your personal belongings. Creative Catharsis reserves the right to reject a request for participation in the “color blasted catharsis” service or any other if a client appears to present visible signs of alcohol or drug intoxication, without refund of the payment made by such a client. During the service, Creative Catharsis Studio Instructors (Artists) give recommendations on how to create a picture of the highest quality, but to allow you to fully merge into a creative process, we give you the freedom to choose independently the color of paint combinations as you wish and lead other creative processes; thus, Creative Catharsis is not responsible for the quality of the dry painting, including cracking defects. Creative Catharsis Studio is not responsible for partial or complete damage to your painting (including loss) from the moment of its hand-over to a courier service, transportation company, or, by your request, to any third party. As a condition of taking part in any activity provided by Creative Catharsis, you agree to execute and sign the Waiver Agreement.
COVID POLICY
If Creative Catharsis is required to close due to federal, state, or local public health authority’s mandates, your deposit will be transferred to a later date when Creative Catharsis is permitted to reopen. In case you tested positive for COVID-19 after making the reservation of the service (confirmed by the test result) and have not informed us of the cancellation more than 24 hours before the start of the service, the studio does not provide any refund and will be forced to deny the provision of services to you to guarantee the health protection for our employees and other guests. The California law stipulates that a person with COVID-19 should stay home, but this regulation does not mean that Creative Catharsis should incur losses by initiating a partial or a full refund of the payment made.
